Succession
A succession is where a tenant dies and another person has
successfully taken over the rights of their tenancy. By law a
tenancy can only be handed on once.
When a tenant dies, any joint tenant will automatically succeed
their tenancy, providing a succession has not already occurred. If
there is no joint person named on their agreement then a partner
(whether married or unmarried or same sex couples), can ask to be
considered for the succession.
In order for a person to succeed a tenancy they must have lived
with the tenant for 12 months prior to the tenants’ death. Joint
tenants and married or civil partners are required to be living in
the home as their only home at the time of death.
If a tenant is not married and holds no joint status then
another family member can apply to succeed their tenancy as long as
they have been living in the home with the tenant, for at least a
year. This is subject to assessment and only possible under certain
conditions.
To apply for succession Ascham Homes must have the request in
writing within 3 months of the tenants passing away. All succession
requests are considered by the Council who is responsible for
deciding if the succession is agreed or refused.
