Evictions

Ascham Homes’ aim is to sustain tenancies by avoiding evictions wherever possible. However there are cases where we will enforce the Council’s tenancy agreement where a breach has occurred.

The main reasons why people are being evicted are;

  • Rent Arrears
  • Anti Social Behaviour

 

Before a tenant is evicted, Ascham Homes on behalf of the Council must apply to the county court for a possession order. There are three types of possession orders which could be granted by the courts.

 

  • Outright possession order,
  • Suspended possession order
  • Postponed possession order.

 

The differences between the three possession orders affect whether or not a tenant is allowed to stay in their property whilst complying with the terms and conditions of that order, or whether a tenant must give up their tenancy within a specified number of days.

 

In the case of a suspended possession order or postponed possession order, if a tenant breaches the terms set by the Court then Ascham Homes can apply to enforce the possession order. The tenant will be notified of the date when the possession order will be enforced and they will be evicted.

 

In the case of an outright possession order, the tenant will be notified of the date when the possession order will be enforced and they will be evicted.

 

Tenants are required to remove all of their belongings from the property.

If you believe someone has vacated, sublet or is illegally occupying a Council property report it to 020 8496 4299. Your report will be dealt with in confidence.
