Subletting

You have the right to take in a lodger, as long as this does not create overcrowding, but you must let us know that you are doing so. You must make sure that you have our permission in writing before a lodger moves in. We can refuse to allow you to sublet part of your home without good reason.
 
You can challenge in court our decision to refuse permission for you to sublet and it is up to us to defend it. In this case you should get independent legal advice.
If you are receiving benefits, make sure you tell the Housing Benefit and Council Tax offices about your lodger before they move in. You can contact that office on 020 8496 3000.
 
You are responsible for making sure that your lodger keeps to the terms of your tenancy agreement, and you should be aware that we cannot act on your behalf if you have any difficulties with your lodger. If your lodger does not behave responsibly, you could lose your home.
 
You cannot sublet the whole of your property. This would be breaking your tenancy agreement and would result in you losing your secure tenancy and being evicted from your home.
